Terms of Service

1. Scope

These Terms of Service apply to all contracts between Alexander Bergmann (referred to as "Provider") and the user of the Sanctions Compliance Platform (referred to as "User").

2. Service Description

The Provider offers a SaaS platform for checking persons, companies, and entities against international sanctions lists. The platform provides both a web frontend and a REST API for programmatic access.

3. Registration and User Account

Registration is required to use the platform. The User is obligated to provide truthful information and keep their login credentials confidential. The User is responsible for all activities that occur under their account.

4. Prices and Subscriptions

Current prices are available on the website. The Provider offers various subscription models: Free (5 searches/month), Standard (500 API calls one-time for €5 excl. VAT), Unlimited (€50/month excl. VAT). All prices are exclusive of applicable VAT.

5. Payment

Payment is processed through the payment service provider Stripe. For subscriptions, the amount is charged monthly in advance. In case of payment default, the Provider reserves the right to suspend access to the platform.

6. Usage Rights and Obligations

The User receives a non-exclusive, non-transferable right to use the platform. The following uses are prohibited:

• Sharing login credentials with third parties
• Automated mass queries outside the API
• Reverse engineering or decompiling the software
• Use for illegal purposes

7. Liability

The Provider is fully liable for intent and gross negligence. In case of slight negligence, the Provider is only liable for breach of essential contractual obligations and limited to foreseeable, contract-typical damages. Liability for data loss is limited to typical recovery costs.

8. Disclaimer

Sanctions data is obtained from public sources. The Provider does not guarantee the completeness, accuracy, or timeliness of the data. The platform does not replace legal advice. The User is responsible for compliance with their own compliance obligations.

9. Termination

The free tier can be terminated at any time without giving reasons. Paid subscriptions can be terminated at the end of the respective billing period. The Provider may terminate the contract without notice for good cause.

10. Changes to Terms

The Provider reserves the right to change these Terms. Changes will be communicated to the User by email. If the User does not object within 4 weeks, the changed Terms are deemed accepted.

11. Applicable Law and Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes is Stuttgart, if the User is a merchant.
